JUSTICE ARUN KUMAR ORAL ORDER 09-03-2017 Heard learned counsel for the petitioner and the State. Petitioner seeks bail in Khodawandpur P.S. Case No.263 of 2014 registered under Sections 302, 120(B)/34 of the Indian Penal Code.

Allegation in brief is that the informant's husband was killed by one Rajesh Das along with his associates including the petitioner as Rajesh Das had taken loan from the informant's husband and was not willing to return back.

Submission is that earlier a U.D. Case No.7 of 2014 relating to death of the husband of the informant was lodged and after lapse of ten months, the present complaint case was filed moreover the principal accused Rajesh Das against whom motive is alleged has been granted bail by a Co-ordinate Bench of this

Patna High Court Cr.Misc. No.8442 of 2017 (3) dt.09-03-2017 2/2 Court vide Cr. Misc. No.48122 of 2016 and the case of the petitioner stands on a better footing.

Considering the said facts and circumstances, let the petitioner, namely, Radha Krishna Das be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Manjhaul (Begusarai) in connection with Khodawandpur P.S. Case No.263 of 2014.
