Petitioners apprehend their arrest in Dhanaha P.S. Case No.86 of 2019 registered under Sections 341, 323, 354, 379, 504 and 34 of the Indian Penal Code.

The informant named the petitioners and alleged that the petitioners were quarreling with Santosh Singh and when the informant intervened to pacify the quarrel, the petitioners assaulted her with bamboo stick and also snatched her ornaments.

Learned counsel for the petitioners submits that no occurrence as alleged by the informant ever took place. In fact

Patna High Court CR. MISC. No.49720 of 2019(2) dt.13-08-2019 2/2 the informant sustained injury on her head. No specific allegation of assault is made against the petitioners. The other offences are bailable. The allegation of theft of mangal sutra is ornamental.

Having considered the facts and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. III, Bagaha, West Champaran in connection with Dhanaha P.S. Case No.86 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
