JUSTICE SUDHIR SINGH ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections 323, 379, 504/34 of the Indian Penal Code.

The case of the complainant, in short, is that the complainant has got some piece of land in village Diwari and some piece of the land has been acquired for installation of T.V. center and the karamchari has given wrong report about the said land then the complainant along with his witnesses had gone before the karamchari on 6.4.2004 and requested for rectification of the report but the accused persons abused and assaulted him and it is alleged that accused Ashok Yadav snatched his bag containing cash of Rs. 640/-.

It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.50157 of 2016 (2) dt.22-11-2016 2/2 petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The complaint case has been filed for oblique reason. The petitioner is a Revenue Karamchari. There is no chance of his absconding. On behalf of the State, it is submitted that the petitioner is named in the FIRR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest/surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) each with two sureties of the like amount each to the satisfaction of Mr. Nayan Kumar, learned Judicial Magistrate, Saharsa, in Complaint Case No. 325C/2004,subject to the conditions as laid down u/s 438(2) Cr.P.C.
