In this case, the petitioner has raised a grievance that thousand of persons have illegally encroached the river-bed as well as the area which is meant for religious works. He has also drawn attention of the Circle Officer whereby the Circle Officer has

Patna High Court CWJC No.16977 of 2019 dt.26-08-2019 2/2 given instruction to the Muffasil police station to take action for removal of the illegal construction.

The Circle Officer is very conscious of the encroachment. It is the duty of the Circle Officer as well as the officials of the Police Station to prevent any encroachment over the land which is meant for the Mela purpose or for any public use or in the river bed. The District Magistrate, Gaya should ensure removal of illegal encroachment after following the due process of law.

With the aforementioned observation and direction, this writ application is disposed of.
