JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-05-2017 Learned counsel for the petitioner is permitted to make necessary correction in prayer portion of this petition. Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 272/273 of the Indian Penal Code and 30(i), 41(i) & (ii) of Bihar Excise Act.

Accusation is that after search of the house of Shammi Nut, 10 bottles of foreign liquor each containing 750 ml and 34 bottles of foreign liquor each containing 375 ml respectively were recovered from the courtyard concealing in paddy straw where the petitioner was apprehended.

Submission is that the petitioner is the brother-in-law of

Patna High Court Cr.Misc. No.20072 of 2017 (2) dt.10-05-2017 2/2 Shammi Nut. In fact, the petitioner had gone to the house of his sister where he has been apprehended by the police mere on suspicion. The petitioner has no criminal antecedent and he is in custody since 30.01.2017.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judgre-2,Rohtas at Sasaram, in connection with Dehri (Town)P.S.Case No. 58 of 2017.
