2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 18.01.2024 passed in Cr. Misc. No. 1919 of 2024.

3. The petitioner seeks regular bail in connection with NDPS G.R. No. 07 of 2024, Hajipur (Excise) P.S. Case No. 454 of 2023 registered for the offence under Sections 20(b)(ii) of the NDPS Act.

4. The following order was passed on 18.01.2024 in Cr. Misc. No. 1919 of 2024:- Heard learned counsel for the petitioner and learned APP for the State.

2. This application for grant of regular bail arises out of Hajipur (Excise) P.S. Case No.454 of 2023 registered for the offence punishable under Sections 20(b)(ii) of the N.D.P.S. Act.

3. The recovery is of 18 kgs. of ganja from the possession of the petitioner. The petitioner is in custody since 17.07.2023.

5. Considering the quantum of ganja

Patna High Court CR. MISC. No.56892 of 2024(3) dt.30-01-2025 2/2 recovered from the possession of the petitioner, I am not inclined to grant the petitioner privilege of regular bail. Accordingly, this application is accordingly rejected.

6. The trial court is directed to expedite the trial and conclude the same as early as possible. In case, there is delay in trail not attributable to the petitioner, the petitioner may renew his prayer for bail.

5. There is recovery of 18 kg of Ganja from the possession of the petitioner who is in custody since 17.07.2023. The charge has already been framed.

6. The Special Judge is directed to proceed with the trial.

7. The Superintendent of Police, Vaishali is directed to see to it that the witnesses are produced on the dates fixed so that the trial is not delayed.

8. With the aforesaid observation and direction, this application is dismissed again.

9. If the trial is delayed by the prosecution, the petitioner may renew his prayer for bail.

10. Let a copy of this order be communicated to the District Judge, Vaishali and Superintendent of Police, Vaishali through FAX for its compliance forthwith.
