JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Siwan R.P.F. P.S. Case No. 02 of 2016, registered under Section 3 of R.P.U.P. Act.

The accusation is of recovery of 20 pieces of Pendraul clip of sleeper of the railway kept in a plastic bag, belonging to the petitioner, out of which 18 pieces of Pendraul clips were found in good condition and other 2 pieces were found in broken condition.

Learned counsel for the petitioner submits that, in fact, the petitioner has falsely been implicated in this case merely on suspicion and petitioner has no criminal antecedent is in custody since 10.07.2016.

No.2450 of 2017 (2) dt.06-02-2017 2/2 Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Sonepur, Saran in connection with Siwan R.P.F. P.S. Case No. 02 of 2016. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
