1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Buxar Excise P.S. Case No. 546 of 2023 dated 15.07.2023 registered for the offence(s) punishable under Section(s) 30(a) of the Bihar Prohibition and Excise Act.

3. The main submissions advanced by the learned counsel for the petitioner are that the instant matter relates to the recovery of 375 ml. of foreign liquor from the possession of three accused persons including the petitioner, in fact the alleged liquor was not recovered from the possession of this petitioner and one co-accused, namely, Laxman Kumar, who was apprehended along with this petitioner, has already

No.54827 of 2023(2) dt.30-08-2023 2/2 been granted bail by the court below itself on 22.07.2023, petitioner is a very young person, though against him, there is criminal antecedent of one case but he has got bail in the said case and in the present matter, he has been languishing in jail since 16.07.2023.

4. Considering the above submissions, this Court is inclined to accept the bail prayer of the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Buxar Excise P.S. Case No. 546 of 2023 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
