The petitioners apprehend their arrest in Bettiah Muffasil P.S. Case No.229 of 2019 registered under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

The informant went in raid on secret inputs in village Chhawani and recovered liquor in front of the house of the petitioners. Nothing has been recovered from the house of the petitioners. Nobody has seen the petitioners selling the liquor. It would appear from perusal of the F.I.R. itself that police recovered small quantity of liquor in front of the houses of different persons including the petitioners.

No.49700 of 2019(2) dt.08-08-2019 2/2 Taking into consideration the facts aforesaid and nature of allegation made against the petitioners and the fact that nothing has been recovered from the house of the petitioners rather the recovery was made from the road situated in front of the house of the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, West Champaran at Bettiah in connection with Bettiah Muffasil P.S. Case No.229 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
