2. In this case, the petitioner is seeking regular bail in connection with Kishanpur P.S. Case No. 33 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 109, 118(2), 309(5), 61(2), 3(5) of the BNS and 27 of Arms Act. Later on, Section 103(1) of BNS was added.
3. On 25.02.2025 at about 10:00 PM, the informant's 16-year-old son was returning from a wedding ceremony. In the way, three accused persons attempted to snatch his motorcycle. During the incident, the accused restrained him and one of them fired gunshot at his left temple, causing serious injury. The informant alleges that the accused persons including

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. During investigation, it has come to light that the deceased had illicit relationship with the wife of co-accused Gurudev, and coaccused Gurudev shot the deceased dead. The only allegation against the petitioner is that he caught hold of the deceased. He has submitted further that there is no motive for the petitioner to kill the deceased. The motive is assigned to co-accused Gurudev. The petitioner is under custody since 12-03-2025 and he is a person of clean antecedent.
5. On the other hand, the learned APP for the State has opposed the prayer for bail by submitting that the petitioner brought the deceased to the place of occurrence and caught hold of the deceased.
6. The FIR itself shows that the deceased had illicit relations with the wife of Gurudev. The petitioner is under custody since 12-03-2025 and he is a person of clean antecedent.
7. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on
Patna High Court CR. MISC. No.53138 of 2025(5) dt.08-01-2026 3/3 bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S. Case No. 33 of 2025, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
