The application is for grant of bail for the offence under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code. It has been submitted on behalf of the petitioners that no specific allegation has been levelled against any of the petitioners rather there is a general allegation of assault by 'lathi and danda'. It has further been submitted that the injury report, a copy of which is annexed with this petition as Annexure-2 series, clearly shows that all the injuries are simple in nature and prior to that the petitioner no.1 had filed a complaint petition against the informant. Having heard both sides and in view of the fact that there is a general and omnibus allegation against the petitioners and the injuries are said to be simple in nature as well as there is a case and counter case, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of ACJM-VIII, Saran at Chapra in connection with Mashrakh P.S.Case No.235 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
