The petitioners being the wives of the brothers of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code. The prosecution case is of killing the sister of the informant after 22 years of the marriage. It is submitted by learned counsel for the petitioners that the accusation is omnibus and general. Moreover, the informant has subsequently retracted from the
Patna High Court Cr.Misc. No.41177 of 2015 (2) dt.07-10-2015 2/2 initial version and filed a petition to that effect before the learned court below.
Considering the nature of accusation and the petitioners being ladies, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Belaganj P.S. Case No. 104 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
