ANJANA MISHRA ORAL ORDER 19-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 13.05.2019 in connection with Barauli P.S. Case No.116 of 2019 registered for the offence under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that on account of a petty dispute between the parties with regard to the damaging of cucumber (Khira) field of the petitioner, there ensued a scuffle and on a spur of the moment, the alleged injury is said to have been inflicted by the petitioner accidentally.Further the said injury was found to be simple in nature. Case No.116 of 2019.
