Prayer is for grant of anticipatory bail in Sakatpur P.S. Case No. 70 of 2017 registered under sections 147,148,149,323,324,332,337,353, 188 and 153(a) IPC. It is stated that there is general and omnibus allegation against the petitioners in relation to the incident that occurred on the day of Moharram festival.
Counsel for the State opposed the prayer and submitted that few police personnel(s) also received injuries. Regard being had to the allegation, although general in nature, and other materials reflected from the record, the Court,
Patna High Court Cr.Misc. No.2679 of 2018(2) dt.15-01-2018 2/2 while declining the relief for grant of anticipatory bail, permits the petitioners to surrender in the court below and pray for regular bail. If they do so within four weeks, the learned court below shall consider their case(s) for grant of bail on merit in accordance with law unprejudiced by the present order.
