The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has antecedent of two cases and that too of the year 2011 and 2015, it is submitted that from 2015 till 2022 no other case was instituted against him, it is further submitted that one Prince Kumar was arrested from whom arms and cartridges were recovered as detailed in the FIR and he disclosed that the same belongs to the petitioner.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is

No.54028 of 2022(2) dt.21-10-2022 2/2 next submitted that the name of the petitioner transpired in the confessional statement of Prince Kumar in police custody which does not have any evidentiary value. It is also submitted that petitioner is known to Prince Kumar and has dispute with him on account of which he falsely implicated him. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sheikhpura P.S. Case No. 450 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. with a further condition that one of the bailors of the petitioner shall be the cousin brother of the petitioner, Ajay Kumar.
