In this case, the petitioner is apprehending his arrest in connection with Naubatpur P.S. Case No. 274 of 2017 registered for offences under sections 147, 148, 149, 323, 324, 325, 326, 307, 302, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
As per allegation made in the First Information Report, there was a land dispute between the parties. Allegation has been made that the persons from the petitioner side used lethal weapons and killed the son of the Informant, namely, Ravi Shekhar.
Learned counsel for the petitioner submits that from their side also, three persons have died and further said
Patna High Court Cr.Misc. No.22823 of 2018(2) dt.27-04-2018 2/2 that other co-accused persons have also been granted bail. Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner, namely, Ashok Yadav is rejected.
