Learned counsel for the petitioners seeks permission to withdraw the present application which has been filed for quashing of the order dated 14.01.2013, passed by learned C.J.M. Patna, in connection with Phulwarisharif P.S.Case No. 327 of 2012 by which the learned Magistrate has taken cognizance for the offences under Sections 341, 323, 186, 504/34 of the IPC and 3(1)(x) of the SC/ST (Prevention of Atrocities) Act against the petitioners.

Patna High Court Cr.Misc. No.45604 of 2013 (3) dt.13-01-2017 2/2 Permission is accorded.

The application is, accordingly, dismissed as withdrawn.

The interim stay granted to the petitioners vide order dated 29.10.2013, stands vacated.

The petitioners will be at liberty to raise all the points at the time of framing of charge.
