This application has been filed for modification of the order dated 21.07.2023, passed in Cr. Misc. No.13011 of 2023. 3.

It is submitted that at the time of passing of the order, without the consent of the petitioner, it was submitted by learned counsel for the petitioner that petitioner is ready to deposit a sum of Rs.11,00,000/- before the learned Court below whereas the petitioner is not in a financial position to deposit the said huge amount.

Considering the aforesaid facts, the petitioner is directed to surrender before the learned Court below in connection with Dalsing-Sarai P.S. Case No.317 of 2022 and pray for regular

Patna High Court CR. MISC. No.64512 of 2023(2) dt.06-10-2023 2/2 bail and the learned Court below would pass the order, preferably, on the same day, without being prejudiced of the order dated 21.07.2023, passed in Cr. Misc. No.13011 of 2023. 5.
