The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 342, 435, 307, 353, 332, 333, 120(B), 431, 427, 337, 504, 506, 109, 151, 152, 186 of the Indian Penal Code, Section 3/4 of the Damage to Public Property Act and Section 27 of the Arms Act.

The accusations are of creating nuisance,

Patna High Court CR. MISC. No.64677 of 2021(3) dt.23-08-2022 2/3 assaulting the police officials, obstructing the road and preventing the police officials in performing their official duties.

It is submitted by learned counsel for the petitioner that there is general and omnibus allegation against the petitioner. The petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged occurrence. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Harsidhi P.S.
