Petitioner seeks bail in connection with Supaul P.S. Case No. 202 of 2016 registered under Sections- 302 and other allied sections of the Indian Penal Code. Learned counsel for the petitioner submits that perusal of the post mortem report shows that the deceased died due to cardiac arrest and taking advantage of the same the informant falsely implicated the petitioner and his family members due to previous enmity. Petitioner has no criminal antecedent and is in custody since 06.12.2016. Similarly situated co-accused persons have been granted bail by this Court vide order dated 31.08.2016 passed in Cr. Misc. No.

Patna High Court Cr.Misc. No.4230 of 2017 (2) dt.06-03-2017 2/2 22729 of 2016.

Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No. 202 of 2016.
