JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-11-2019 The petitioner seeks regular bail in connection with Khudaganj P.S. Case No. 92 of 2018, registered for offences punishable under Sections 304(B)/201/34 of the Indian Penal Code.

Petitioner happens to be husband of the deceased and allegation against him is of causing death of deceased in connection with demand of dowry.

It has been submitted on behalf of the petitioner that statement of one of the family members of the informant has been recorded, which disclosed that daughter of the deceased had stated that the deceased had committed suicide by setting. Further submission is that he has been in judicial custody for one year and there is no likelihood of conclusion of trial in near

Learned counsel for the State opposed the prayer for bail and submitted that the death has occurred in the house of the petitioner and no information has been given to the police. Having heard both sides, considering the facts and circumstances of the case, at this stage, I am not inclined enlarge the petitioner on bail, however, once there is substantial progress in trial, petitioner will be at liberty to move before the trial court for grant of regular bail, which will be disposed of by the trial court on the basis of materials available at that time.
