JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Ara Nawada P.S. Case no. 598 of 2016 registered under Sections 324, 307, 379/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner has got no criminal antecedent. Petitioner has falsely been implicated in the present case. From the F.I.R. it is apparent that there is enmity between the petitioner and informant. Earlier petitioner has filed a case against the informant and the present case is counter-blast to the same. Learned A.P.P. has opposed the prayer for
Patna High Court Cr.Misc. No.54392 of 2016 (4) dt.10-02-2017 2/2 anticipatory bail and stated that petitioner is named in the F.I.R. The injury report of the informant shows that there was fire arm injury with charred margin and injuries received by the petitioner are caused by hard and blunt substance.
Having considered facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected.
However, petitioner is directed to surrender in the court below, i.e., Chief Judicial Magistrate, Ara, Bhojpur, and make prayer for regular bail, which will be considered and disposed of on its own merit without being prejudiced by the order of this Court.
