The petitioner is accused in connection with Town P.S. Case No. 375 of 2016, registered under Section 341, 323, 353, 307, 504 and 506/34 of the Indian Penal Code. The accusation is that petitioner along with Ram Naresh Sahni, Dharmendra Singh @ Jugnu Singh, Ajit Rai and Pooja Kumari, being the under trial prisoner, were carried for production in the Court. At that time, Dharmendra Singh @ Jugnu Singh dashed the constable and all of a sudden they started fleeing anyhow they were apprehended by the Police personnel and taken in the lock up.

Learned counsel for the petitioner submits that it

No.4850 of 2017 (2) dt.02-03-2017 2/2 would appear from the F.I.R. that name of the petitioner has been disclosed by the informant as he was also with the coaccused Dharmendra @ Jugnu Singh at the time of occurrence for production in the Court. Further submission is that similarly situated co-accused, Ajit Kumar Rai has already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 27.09.2016 passed in Criminal Misc. No. 40362 of 2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in connection with Town P.S. Case No. 375 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
