ANJANA MISHRA ORAL ORDER 02-05-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. Petitioner No.2 Rajendra Yadav and Petitioner No.4 Rauki Yadav are apprehending their arrest in connection with Barachatti (Mohanpur) P.S. Case No.274 of 2015 for allegedly having committed the offences under Sections 147, 341, 323, 307, 504, 379 and 506 of the Indian Penal Code. Case diary in the present cased was called for, which has since been received.

Learned counsel for the petitioners submits that there is a case and counter case between the parties and the injuries sustained on both sides. Learned counsel submits that Petitioner

No.48314 of 2015 (3) dt.02-05-2016 2/2 No.1 Ramdeo Yadav, who has since been taken into custody and his application has become infructuous, had filed a case, bearing Barachatti P.S. Case No.220 of 2015 dated 8.6.2015. It is further submitted that the present case is a sequel to the earlier case filed by the petitioners in which the entire family members have been made accused persons.

Considering the nature of allegations made and that the two petitioners have no criminal antecedents, let Petitioner No.2 Rajendra Yadav and Petitioner No.4 Rauki Yadav, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the court of Shri Narendra Pal Singh, Judicial Magistrate, 1st Class, Sherghatti, District-Gaya, in connection with Barachatti (Mohanpur) P.S. Case No.274 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
