2. The petitioner is in custody in a case registered for the offence punishable under Sections 317(4), 317(5), 338, 336(3), 61(2) and 3(5) of the BNS.
3. As per allegation in the FIR, it is a case of recovery of one Splender motorcycle bearing registration no.BR-05U5456 from the possession of the petitioner and other co-accused person.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that there is no recovery from the possession of the petitioner and similarly situated co-accused has already been
Patna High Court CR. MISC. No.52289 of 2025(3) dt.15-10-2025 2/2 granted bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 58250 of 2025 and petitioner is in custody since 02.04.2025.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. In view of the aforesaid facts and circumstances as well as the fact that similarly situated co-accused has been granted bail by Co-ordinate Bench of this Court, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari/concerned Court, Motihari, East Champaran in connection with Patahi P.S. Case No.143 of 2025.
