The petitioner seeks bail in Rajapakar P.S. Case No. 189 of 2021, registered for the offence punishable under Sections 414/34 of the Indian Penal Code and sections 25(1-b)a, 26 and 35 of the Arms Act.

As per the prosecution case, this petitioner along with other co-accused were apprehended with a motorcycle and on search, one knife was recovered from possession of this petitioner.

It is submitted on behalf of the petitioner that no incriminating article has been recovered from possession of this petitioner. Petitioner is not the owner of vehicle in question and the same was being driven by co-accused and petitioner was simply a pillion rider. Petitioner is in custody since 19.07.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Hajipur at Vaishali in connection with Rajapakar P.S. Case No. 189 of 2021.
