Learned counsel for the petitioner undertakes to remove the defects within three weeks.
The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 392 of the Indian Penal Code.
Allegation against the petitioner is that he along with others co-accused persons is said to have snatched the bag with money of the informant.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is no specific overt act against the petitioner. He further submits that petitioner is not named in the
Patna High Court CR. MISC. No.54283 of 2022(2) dt.15-12-2022 2/2 F.I.R., apprehended person disclosed the name of the petitioner that he is also involved in this case. He submits that all the articles/ money was recovered from the conscious possession of the co-accused persons. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application. Learned APP for the State opposes the prayer for bail. Considering the nature of the offence, I am not inclined the enlarge the petitioner on bail in connection with Dariyapur P.S. Case No.431/2021. Accordingly, his prayer for anticipatory bail is hereby rejected.
