This application is for grant of anticipatory bail for the offence under Section 47(A) of the Bihar Excise (Amendment) Act, 2016.
The allegation is that from a Bolero, 131 bottles of Royal Stage liquor and one checkbook as well as cheque book issued in favour of the petitioner and the Adhar Card were also recovered.
Heard learned A.P.P. also, who also could not point out anything except the aforesaid facts.
Having heard both sides and in view of the fact that nothing has been recovered from the conscious possession of the

No.48679 of 2016 (3) dt.19-12-2016 2/2 petitioner, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of CJM, Vaishali at Hajipur in connection with Sadar (Hajpur) P.S.Case No.220 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with a condition that the petitioner will co-operate in the investigation of the trial of the case and make himself available on each and every dates, if required, otherwise the prosecution is free to move for cancellation of the bail bond of the petitioner.
