JUSTICE SANJAY PRIYA ORAL ORDER 04-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Section 414 of the Indian Penal Code, Section 139 of Electricity Act, Sections 25(1-B)A, 26 and 35 of the Arms Act. It is alleged that on the date of occurrence, police in course of checking vehicles, stopped one Ambasador Car, but all the four persons sitting on the car, managed to flee away. Police searched the car and recovered various articles including the firearm as mentioned in the seizure list.

It is mentioned in the impugned order itself that the name of the petitioner has been disclosed by co-accused Etwari Kewat and Shankar Kewat. Thereafter, the police recorded confessional statement of the petitioner as mentioned in

Patna High Court Cr.Misc. No.2281 of 2017 (2) dt.04-02-2017 2/2 paragraph-60 of the case diary. The petitioner is said to be in custody since 2.10.2016. It has been submitted that the petitioner has clean antecedent Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Nalanda at Biharsharif, in connection with Chabilapur P.S. Case No. 44 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioners.
