The petitioner is apprehending his arrest in a case registered under Sections 147, 148, 341, 323, 324, 307, 354 and 302 of the Indian Penal Code.
Allegation is that the accused persons brutally assaulted the informant, his son Santosh Paswan and bhagina Manoj Paswan. In course of treatment his bhagina Manoj Paswan died. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. Altogether eight persons are named in the F.I.R. The petitioner has been named by one Binod Paswan, who has named 13 persons including the petitioner. General and omnibus allegation has been made by the said
Patna High Court Cr.Misc. No.43410 of 2016 (3) dt.21-11-2016 2/2 witness. Though the informant is an eye witness to the alleged occurrence but still he did not name the petitioner. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Benipur, Darbhanga in connection with Bahera P.S. case No.59 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
