JUSTICE SANJAY PRIYA ORAL ORDER 04-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 25(1-AA) and 26(i) of the Arms Act. It has been submitted on behalf of the petitioner that police prepared common seizure list which does not disclose that any firearm was recovered from specific possession of the petitioner. It has further been submitted that the petitioner has clean antecedent. He is in custody since 1.8.2016. It has further been submitted that one of the co-accused has been granted bail by a coordinate Bench of this Court vide order dated 14.12.2016 passed in Cr. Misc. 50072 of 2016.
Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on
Patna High Court Cr.Misc. No.2286 of 2017 (2) dt.04-02-2017 2/2 furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IVth, Khagaria, in connection with Sessions Trial No. 359 of 2016 arising out of Khagaria (Muffasil) P.S. Case No. 471 of 2016, G.R. No. 1613 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
