JUSTICE SUDHIR SINGH ORAL ORDER 20-01-2016 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Patna City Chowk P.S. Case No. 66 of 2015 for the offences instituted under Sections 147, 148, 149, 504, 427 and 436 of the Indian Penal Code.
As per prosecution case that all the accused persons along with 50-60 unknown came variously armed and kept the dead body of one Mahabir Singh in front of the house of the informant and abused the brother of the informant when coaccused Ajit Singh took Rs.45,000/- from the cash box and Suresh Singh instigated the miscreants to made obstruction and rob the articles. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner has been made accused due to mistake of fact. No specific allegation has been made against the petitioner. The specific allegation is made against co-accused Mahesh Singh, Ajit Singh and Suresh Singh. The other co-accused persons have been granted anticipatory bail by this Court vide Cr.Misc.No.35931 of 2015.
On behalf of the State and the counsel for the Informant, it has been submitted that the petitioner is named in the F.I.R. and he has actively participated in the alleged occurrence. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Patna City Chowk P.S. Case No. 66 of 2015 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Patna City, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
