2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 103(1), 3(5) of the Bharatiya Nyaya Sanhita.
3. As per prosecution case, informant suspects that the F.I.R. named accused persons committed murder of her fatherin-law.
4. Learned counsel for the petitioner submits that as per the eye witness of the alleged occurrence, namely Karan Kumar, it was co-accused Omprakash Singh who assaulted the deceased. This petitioner is only alleged to be present at the place of occurrence and there is no specific accusation of overt act against him. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed

Considering statement of the eye witness, namely, Karan Kumar, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge-V, Danapur, Patna in connection with Bihta P. S. Case No. 242 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
