The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420, 423, 467, 468, 471 and 120B of the Indian Penal Code. Both sides are agnates. Complaint based allegation is that the petitioners have entered into an agreement to sell the share
Patna High Court Cr.Misc. No.44575 of 2016 (3) dt.10-02-2017 2/2 of the complainant to some other person. A suit for partition is going on for the disputed subject matter. The petitioners have denies the statement of the opposite party no. 2 in paragraph 5 of the reply to the counter affidavit of opposite party no. 2. Considering the entire facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur/Successor Court in connection with Muzaffarpur Sadar Police Station Case No. 461 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
