JUSTICE SANJAY PRIYA ORAL ORDER 28-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 272, 273 of the Indian Penal Code, Sections, 30(a), 38 and 41 of Bihar Excise (Amendment) Act, 2016.

It has been submitted that 12.900 liter liquor has been recovered from the motorcycle on which the petitioner along with one Rupesh Kumar was sitting.

It has been submitted that Rupesh Kumar has already been granted bail by a coordinate Bench of this Court vide order dated 11.1.2017 passed in Cr. Misc. 551 of 2017. It is mentioned in paragraph-3 of the bail petition that the petitioner has no criminal antecedent. It has further been submitted that the

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi, in connection with Pupri P.S.
