The petitioner filed this writ petition for a direction to the respondents to settle the land of Khata No.1655 Khesra No.6532 measuring area 10 decimals situated in village Madhura P.S. Narpatganj, Forbesganj, District-Araria. From perusal of the report, it appears that land in question was settled in favour of Jagat Lal Paswan and his name was mutated. The petitioner filed petition before the C.O. for issuance of purcha under Bihar Privileged Persons Homestead

Patna High Court CWJC No.16578 of 2019(2) dt.19-08-2019 2/2 Tenancy Act but it appears that revenue clerk only reported that the petitioner is residing on the land for many years but no notice was issued to Jagat Lal Paswan on whose name the land was standing. There is a procedure for holding an inquiry by the Circle Officer under the Bihar Privileged Persons Homestead Tenancy Act and for issuance of notice to the landlord. Having considered the facts, I direct the Circle Officer to proceed further in accordance with law and dispose of the petition of the petitioner within six months from the date of receipt of this order. With this observation, this writ petition is disposed of.
