JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 47, 53(C), 54 of Bihar Excise (Amendment) Act, 2016.
Three bottles, each containing 750 ML. Indian made foreign liquor, are said to have been recovered from conscious possession of the petitioner while he was going on a motorcycle. The informant claims that aforesaid motorcycle was stolen property.
Considering the aforesaid facts and circumstances as

No.46644 of 2016 (3) dt.06-12-2016 2/2 well as submissions of the parties and also taking note of this fact that petitioner is in jail custody since 10.09.2016 without having any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Aditya Pandey, Judicial Magistrate 1st Class, Vaishali at Hajipur in connection with Desari (Chandpura O.P.) P.S. Case No. 194 of 2016.
