JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-04-2018 The petitioners seek bail in anticipation of their arrest in connection with Kanti P.S. Case No. 544 of 2016, dated 06.12.2016, instituted for the offences punishable under Sections 147, 148, 149, 341, 343, 307 and 353 of the Indian Penal Code.

It appears that for protesting against the murder of one Awinash Kumar, approximately two hundred

Patna High Court Cr.Misc. No.16141 of 2018 (2) dt.10-04-2018 2/2 villagers/persons including the petitioners congregated on the National Highway and disturbed the flow of traffic. When the police party came and wanted to disburse the mob, the miscreants entered into scuffle with the police party. Learned counsel for the petitioners has submitted that there is no specific allegation against the petitioners and it is also not ascertained as to how they have been identified and named in the First Information Report by the police. Under similar circumstances, many accused persons have been granted anticipatory bail by co-ordinate Benches of this Court.

Regard being had to the aforesaid facts as also taking into account that there is no injury caused by the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West Muzaffapur in connection with Kanti P.S.
