2. The petitioner apprehends his arrest in a case registered for the offence under Section 272/273 of I.P.C. and Section 30(a) of Bihar Prohibition and Excise Act.

3. Total 135 liters of illicit country-made liquor has been recovered from three different places and name of petitioner transpired during course of investigation.

4. It is submitted on behalf of that nothing has been recovered from the possession of this petitioner and he has been made accused only on suspicion.

5. However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that petitioner has got two criminal antecedent of similar nature.

6. Considering the fact that petitioner has got criminal antecedent of similar nature, the prayer for anticipatory bail of petitioner is rejected.
