JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-08-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 320(C) of 2018, disclosing offences under Sections 420 and 34 of the Indian Penal Code. Complaint petition disclose the allegation that the petitioner sold his Scoropio Vehicle bearing Registration No. BR 10P3638 to the complainant in presence of the petitioner on the basis of forged owner book and the vehicle was financed by the Sri Ram Motor Finance and Rs. Five Lakh was due and the said vehicle was seized by the Financer and the co-accused and petitioner accepted their guilt and ensured to return the money. Submission of learned counsel for the petitioner is that he is not the owner of the vehicle rather it is the co-accused,
Patna High Court CR. MISC. No.50770 of 2019(2) dt.16-08-2019 2/2 who sold the vehicle to the complainant and complaint petition itself disclosed that the petitioner was only a witness of sale of vehicle.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Sheikhpura, in connection with Complaint Case No. 320(C) of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
