The present restoration petition has been filed with a prayer to restore C.W.J.C.No.5053/2005, which stood dismissed on 02.05.2011 due to non-prosecution.

In the writ petition, the petitioner has prayed for regularization of his service with effect from 1990. In paragraph-4, of the petition, the reason has been assigned for non-prosecution. It has been indicated that due to inadvertence of the Advocate

Patna High Court MJC No.1302 of 2014 (3) dt.28-01-2017 2/2 Clerk, the case could not be marked and the same stood dismissed. The reason for non-appearance has been assigned, but nothing has been indicated as to under what circumstances, the present restoration petition was filed after such a long time on 27.03.2014, whereas the writ petition stood dismissed on 02.05.2011. I do not find any ground to restore the writ petition. Accordingly, the present restoration petition stands dismissed. (Rakesh Kumar, J) NKS/- U
