JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-02-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Korha P.S. Case No. 140 of 2016, registered under Section 304(B)/34 of the Indian Penal Code.

The allegation of informant Ram Kmal Singh is that he performed the marriage of his younger daughter with Sonu Kumar Rai, son of the petitioners, due to love affairs between them. After the marriage, Sonu Kumar son of the petitioners used to demand motorcycle and also torturing his daughter. On 31.05.2016, he received information about death of his daughter then he went to her matrimonial house and found her daughter in burnt condition and her husband and other family members were not present at the house. Further allegation is that the daughter of the informant has been killed by her husband due to non-

Learned counsel for the petitioners submits that admittedly there was love marriage between daughter of the informant and Sonu Kumar, son of the petitioners against the will of the informant. Thereafter, deceased, daughter of the informant, went her Myka without invitation on the occasion of marriage of her brother, where she was misbehaved by them, thereafter, she returned at her matrimonial house and committed suicide. Further submission is that it would appear from the F.I.R. itself that there is specific allegation against Sonu Kumar, husband of the deceased for making demand of motorcycle and torturing of deceased. The petitioners are father-in-law and mother-in-law of the deceased are in custody since 12.11.2016.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in connection with Korha P.S. Case No.140 of 2016.
