The petitioner prays for anticipatory bail in connection with Chouri P.S. case no. 34 of 2016 registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and Section 47 of Excise Act.

It is submitted on behalf of petitioner that nothing has been recovered either from possession of the petitioner or from house of the petitioner and name of petitioner disclosed by brother of the petitioner.

Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail.

Patna High Court Cr.Misc. No.48137 of 2016 (3) dt.11-01-2017 2/2 Having heard both sides and in view of the fact that nothing has been recovered from possession of petitioner and name of petitioner has been mentioned by co-accused, the bail application of abovenamed petitioner is allowed and petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate-XII, Arrah at Bhojpur in connection with Chouri P.S. case no. 34 of 2016 with condition that he will cooperate in the investigation of the case.
