JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2018 The petitioner is apprehending his arrest in connection with Fulkaha P.S. Case No. 66 of 2014, registered for offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

Petitioner is named in the F.I.R and allegation against him is of causing death of the husband of the informant. It has been submitted on behalf of the petitioner save and except suspicion, there is nothing against the petitioner so as to connect him with the present case and he has been made accused in this case only on the ground that earlier he had threatened the husband of the informant.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and

No.14208 of 2018 (2) dt.11-04-2018 2/2 circumstances of the case, this application is disposed of with direction to the petitioner to surrender before the court below within a period of four weeks and on his surrender, the court below shall grant him the provisional anticipatory bail to his own satisfaction till submission of chargesheet with condition that on submission of charge-sheet, the petitioner shall surrender before the court below and pray for regular bail, which will be considered by the court below on the basis of materials available on record at that time.
