JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 323, 148, 149, 341, 323, 504, 506 and 307 of the Indian Penal Code.

Heard learned counsel for the petitioners.

It has been submitted on behalf of the petitioners that there is a case and counter case between the parties and, as a matter of fact, this case has been lodged as a counter-blast of the earlier case filed by petitioner no. 3 in which serious allegation of assault was made against the informant and others. In this case also general and omnibus allegation has been made against petitioners and no specific allegation has been made against them. Heard learned A.P.P. also.

No.45392 of 2016 (3) dt.10-01-2017 2/2 Having heard both the parties and in view of the fact that there is case and counter case between the parties and from perusal of the F.I.R. it appears that no specific allegation is there against the petitioners, let above named petitioners, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgaon P.S. Case no. 359 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
