This is an application for bail in connection with Katihar Rail P.S.Case No. 104 of 2016 registered for the offences punishable under Sections 401 of the Indian Penal Code and 20, 22 of NDPS Act, including Sections 137 and 147 of the Indian Railways Act, 1989.
It has been submitted on behalf of the petitioner that there is alleged recovery of 10 tablets of Ativan 0.2 mg. and 15 tablets of Trika 0.5 mg., including one Mobile phone and he is in custody for about three months having clean antecedent. Heard learned APP also.
Having heard both sides and in view of the fact that petitioner having no criminal antecedent and considering the period in custody, let the petitioner, above named, be released on
Patna High Court Cr.Misc. No.10549 of 2017 (2) dt.21-03-2017 2/2 bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Katihar, in connection with Katihar Rail P.S.Case No. 104 of 2016, corresponding to G.R.No. 169 of 2016, subject to the conditions that :- (i) The bailors of the petitioner shall be local persons having sufficient immovable properties within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available on each and every date fixed by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason and without permission of the court, failing which bail bond of the petitioner shall automatically stand cancelled.
