JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-11-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Patepur P.S. Case No. 179 of 2018, registered for the offence punishable under Section 304B/34 of the Indian Penal Code.

As per prosecution case, sister of the informant was married with the petitioner in the year 2013. After marriage all the accused persons including this petitioner started demanding dowry and subjected her to all sorts of torture. Ultimately, this petitioner along with other in-laws committed murder of the sister of informant.

It is submitted by learned counsel appearing on behalf of petitioner that petitioner has falsely been implicated in this case. Deceased died due to diarrhea. Petitioner is in custody since 16.11.2018 having clean antecedent.

Patna High Court CR. MISC. No.49745 of 2019(4) dt.06-11-2019 2/2 Petitioner happens to be husband of the deceased. The dead-body was lying in corridor of the house having many marks on various parts of her body including that on neck. The sister of informant (deceased) died within seven years of her marriage at her sasural.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
