The petitioners apprehend arrest in Darpa P.S. Case No. 55 of 2017 instituted for the offence under Sections 363,366,379,504,506/34 of the IPC.
In the written report, it is alleged that the informant got information on telephone that his wife Sajmera Khatoon was seen going in a Bolero car with someone from Gamhariya Market. The informant has alleged in the written report that Mainullah Ansari has kidnapped his wife with intention to marry. Case diary has been received, wherein, the statement of the mother and brother of the victim girl is recorded at paragraph 18 and 19.
Patna High Court Cr.Misc. No.8099 of 2018(3) dt.21-03-2018 2/3 They have stated that informant is a man of bad character. He has already performed two marriage prior to marrying the victim girl. They have also stated that due to torture of the informant, the victim girl has left the house with her children. In such circumstances, prayer for anticipatory bail is allowed and it is ordered that the petitioners, named above, in the event of their arrest or surrender in the court below within six weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Darpa P.S. Case No.
55 of 2017 to the satisfaction of the learned Sub Divisional Judicial Magistrate, Raxaul at Motihari, subject to condition as laid down u/S 438 (2) of the Cr. P.C.
