2. The petitioner has preferred this application for grant of regular bail in connection with Banmankhi P.S. Case No. 426 of 2024 dated 20.11.2024 registered for the offences punishable under Section 126(2), 115(2), 109, 352, 351(2) read with Section 3(5) of B.N.S.

3. As per the prosecution case, the petitioner along with the co-accused persons stopped the motorcycle of the informant and assaulted him and snatched his mobile phone from his hand, when he was returning home after buying goods from Banmankhi market. It is further alleged that the petitioner attacked on the head of the informant with knife.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The charge-sheet has been submitted against the petitioner. It is further submitted that the informant has no any injury sustained. The petitioner has no concern with the alleged occurrence. The petitioner has three criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody in this case since 25.11.2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Purnea in connection with Banmankhi P.S. Case No. 426 of 2024, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
