Patna High Court CWJC No.11672 of 2023 dt.19-09-2023 2/3 petitioner submits that petitioner was a Class-IV employee posted as Peon in the office of District Manager, Bihar State Food Corporation Ltd., Nalanda and had retired on 31.12.2019. Learned counsel further submits that the petitoner is aggrieved for redressal of retiral benefit for which certain formalities are required to be done by, the Bihar State Food Corporation Ltd. and the petitioner, with respect to the filling of the forms.

3. Considering the fact that petitioner had retired from the post of Peon which is a Class-IV post employee on 31.12.2019 from the office of District Manager, Bihar State Food Corporation Ltd. Nalanda and he is aggrieved for regular pension and other retiral dues which is payable to the petitioner.

The Managing Director, Bihar State Food and Civil Supply Corporation Khadya Bhawan, Patna is directed to verify all the service particulars and records and get the forms filled and forward the same to the Regional Commissioner Employee Provident Fund Organization, Patna, Bihar(respondent no. 6). In case, the petitioner is required to facilitate the disposal of his claim of pension, he may also approach the Regional Commissioner Employee Provident Fund, Bihar.

5. The Regional Commissioner Employee

Patna High Court CWJC No.11672 of 2023 dt.19-09-2023 3/3 Provident Fund, Bihar is directed to expedite the formalities relating to the payment of pension as claimed for in the present writ petition or any other retiral dues which are still to be paid to the petitioner must be expedited by the Managing Director, Bihar State Food and Civil Supply Corporation, Khadya Bhawan, Patna within a period of four weeks from the date of communication of this order without fail.

6. The petitioner must be paid all the retiral dues as claimed for in the present writ petition to which he is legally entitled for within the aforesaid period. In case, petitioner is aggrieved for non co-operation of any of the respondents who have specifically been directed in this in order in taking steps to ensure payment of retiral dues on their respective parts within the aforesaid period, the petitioner may take appropriate legal action against them.

7. With the above observations and directions, the present writ petition stands disposed of.
